‘Wij stelden ons de vraag of een relatief recente (pragmatische) invulling van het artikel 489bis, 4\u00b0 Sw. door het Hof van Cassatie geen aanleiding kan geven tot onvoorziene problemen of onzekerheden.<\/em><\/p>\n

In een korte vergelijking met het Engelse common law, stelden we ons de bijkomende vraag of het strafrecht niet aan vernieuwing toe is op dit punt. Houdt het strafrecht zich niet met teveel bezig? Is de burgerrechtelijke afhandeling van een laattijdige aangifte van faillissement niet voldoende?<\/em>‘<\/p>\n
