{"id":5419,"date":"2020-12-01T11:15:32","date_gmt":"2020-12-01T09:15:32","guid":{"rendered":"https:\/\/cottyn.eu\/?p=5419"},"modified":"2022-04-05T11:21:03","modified_gmt":"2022-04-05T09:21:03","slug":"verplichte-opleiding-voor-bijstand-salduz-verhoor","status":"publish","type":"post","link":"https:\/\/cottyn.eu\/nl\/verplichte-opleiding-voor-bijstand-salduz-verhoor\/","title":{"rendered":"Verplichte opleiding voor bijstand salduz-verhoor"},"content":{"rendered":"<p style=\"text-align: left;\">Vanaf 9 april 2021 zal het verplicht zijn om de bijzondere SUPRALAT opleiding verhoorbijstand te volgen voor advocaten die zich willen inschrijven voor de Salduz-permanentie. Het zal vanaf dan dus niet langer mogelijk zijn voor advocaten (of hun vervangers) om bijstand te verlenen bij een salduz-verhoor zonder de opleiding gevolgd te hebben.<\/p>\n<h2 style=\"text-align: left;\">Oorsprong Salduz-verhoor<\/h2>\n<p style=\"text-align: left;\">Het Salduz-arrest, een arrest van het Europees Hof voor de Rechten van de Mens, werd gewezen op 20 november 2008 en heeft betrekking op rechtsbijstand v\u00f3\u00f3r het eerste verhoor van een verdachte.<\/p>\n<p style=\"text-align: left;\">Dit arrest is er gekomen nadat de heer Yusuf Salduz naar eigen zeggen onder druk werd gezet tijdens zijn eerste verhoor, waardoor hij zijn initi\u00eble bekentenis later bij de openbaar aanklager en onderzoeksrechter introk.<\/p>\n<p style=\"text-align: left;\">Om ieders recht op een eerlijk proces te garanderen moet een verdachte nu altijd toegang hebben tot een raadsman vanaf het eerste (politie)verhoor, ondertussen binnen justitie beter gekend als het \u2018Salduz-verhoor\u2019<sup>1<\/sup>.<\/p>\n<h2 style=\"text-align: left;\">Salduz-permanentielijst<\/h2>\n<p style=\"text-align: left;\">Advocaten kunnen zich inschrijven op de Salduz-permanentielijst als zij bereid zijn om personen die van hun vrijheid beroofd worden te willen bijstaan bij een eerste (politie)verhoor. Die lijst wordt geraadpleegd wanneer verdachten op het moment van hun aanhouding geen vaste advocaat hebben. Van zodra de opdracht aanvaard wordt, heeft de advocaat twee uur de tijd om zich naar de plaats van het verhoor te begeven.<\/p>\n<h2 style=\"text-align: left;\">COTTYN Advocaten is permanent beschikbaar<\/h2>\n<p style=\"text-align: left;\">Of u bij ons terechtkan voor bijstand bij een Salduz-verhoor? Absoluut!<\/p>\n<p style=\"text-align: left;\">Meesters <a href=\"https:\/\/cottyn.eu\/nl\/team\/belgium\/ann-van-de-steen\/\">Ann Van de Steen<\/a> en <a href=\"https:\/\/cottyn.eu\/nl\/team\/belgium\/steffie-carels\/\">Steffie Carels<\/a> hebben de bijzondere opleiding verhoorbijstand reeds succesvol afgerond en meesters <a href=\"https:\/\/cottyn.eu\/nl\/team\/belgium\/lennert-dierickx\/\">Lennert Dierickx<\/a>, <a href=\"https:\/\/cottyn.eu\/nl\/team\/belgium\/leroy-lievens\/\">Leroy Lievens<\/a> en <a href=\"https:\/\/cottyn.eu\/nl\/team\/belgium\/pauline-de-backer\/\">Pauline De Backer<\/a> volgden het opleidingstraject en zullen dit afronden in december 2020.<\/p>\n<p style=\"text-align: left;\">Aarzel dus niet om een van bovenstaande namen door te geven voor de bijstand bij uw verhoor.<\/p>\n<address style=\"text-align: justify;\"><sup>1 <\/sup>Salduz-arrest.
